AN ORDINANCE OF THE TOWN OF DUPONT, JEFFERSON COUNTY, DUPONT, INDIANA, TO ESTABLISH PARKING REGULATIONS AND TO DESIGNATE AREAS WITHIN THE TOWN IN WHICH PARKING IS PROHIBITED AND TO ESTABLISH PENALTIES FOR PARKING VIOLATIONS
PARKING REGULATIONS
GENERAL PROVISIONS
(A) For provisions contained in this ordinance, of the Town Code applies to all vehicles, whether they are self-propelled, animal-drawn, or towed, except for:
- Emergency vehicles responding to an emergency or in pursuit of an alleged law violator,
- Road construction vehicles when engaged in construction work, and
- Other vehicles that are exempt from municipal parking ordinances under applicable law.
PARKING RESTRICTED IN ALLEYS
It shall be unlawful for the operator of any vehicle to stop, stand, or park such vehicle in any alley for a period longer than is necessary for the loading or unloading of passengers or freight. No vehicle shall stand or park in any alley for any such purpose to leave available less than eight feet of the width of the alley for the free movement of traffic.
(A) No person shall park a vehicle within an alley except for the purpose of loading or unloading property or merchandise.
(B)No person shall park a vehicle or block an alley within the limits of the town
(C) No person or object can cause an obstruction of any alley or driveway.
(D) Any vehicle or object found to be obstructing traffic on any alley within the limits of the town shall be removed or caused to be removed by any law enforcement officer or Town Board member observing the violation. The owner of the vehicle shall be responsible for all fines, tow-ins and storage charges resulting from the removal.
SPEED IN ALLEYS
(A) Except when a special hazard exists that requires lower speed for compliance with state law, the maximum lawful speed limit in an alley shall be fifteen miles per hour, and no person shall drive a vehicle in an alley more than such limit.
PARKING RESTRICTIONS
(A) All vehicles shall be parked according to the guidelines drawn upon either the pavement or the curbing.
(B) No vehicle shall be parked:
- Within fifteen feet in either direction of a fire hydrant located at any place within the limits of the town.
- Within ten feet of the center line of the entrance of any public building or church.
- Within twenty feet of any street or highway intersection.
- Within fifteen feet of the nearest rail of a railroad crossing
- At any place where official signs prohibit stopping
- On a sidewalk
- In front of a public or private driveway
- Within thirty feet of the driveway entrance to a fire station
- At any place where official signs prohibit stopping
OBSTRUCTING TRAFFIC
(A) No person shall park any vehicle upon a street, alley, or other public roadway in a manner or under conditions so as to leave available less than ten feet of the width of the roadway for free movement of vehicular traffic.
(B) Any vehicle found to be obstructing traffic on any public roadway shall be removed or caused to be removed by any law enforcement officer or Town Board member observing the violation. The owner of the vehicle shall be responsible for all fines, tow-ins and storage charges resulting from the removal.
(C) No person shall open the door of a motor vehicle on the side available to moving traffic, unless and until it is reasonably safe to do so, nor shall any person leave a door open on the side of a motor vehicle available to moving traffic for a period of time longer than necessary to load or unload passengers.
OVERSIZED VEHICLE, PARKING RESTRICTIONS
(A) It shall be unlawful for any truck, tractor, trailer, bus, house-trailer or semi-trailer having a load capacity in excess of one ton, or a length in excess of 20 feet to be parked upon the public streets and highways of the town except for the purposes of loading or unloading, but in no case for a period in excess of two hours.
(B) Freight-carrying vehicles of more than 23.5 feet in length overall shall not park within the central business district of the city, except in alleys, provided that the vehicles may park in those areas for the purpose of loading or unloading freight between the hours of 6:00 p.m. and 6:00 a.m.
(C) It shall be illegal and unlawful for any person to park a vehicle with a capacity of more than one ton on any street or alley in the town unless the person is in the act of loading or unloading cargo.
ALL NIGHT PARKING ON STREET PROHIBITED
It is unlawful for anyone to park a vehicle, recreational vehicle, trailer, or watercraft on any public street or public right away within the municipality for 24 hours or longer. A vehicle, recreational vehicle, trailer, or watercraft left parked in these areas is considered abandoned and subject to all existing regulations on abandoned vehicles.
ENFORCEMENT AND REVIEW PROCESS
(A) The fine for the violation of most provisions of this Code will not exceed the sum of $50.00 pers violation, each day constituting a separate violation. In addition to the fine assessed pursuant to this ordinance, a vehicle violating any provision of this Code may be towed and impounded at the owner’s expense, such towing and impoundment costs to be paid in full before the release of said vehicle.
(B) All fines received by the Clerk/Treasurer for violations of this Code will be deposited into the Town’s General Fund pursuant to applicable law.
(C) “Who.” Any law enforcement officer or the Town’s Board and Clerk/Treasurer who observes a violation may at their discretion issue a violation citation (Parking ticket).
